摘要
计算机游戏产业通过近些年的迅猛发展已经具有极大的市场规模,拥有十分庞大的游戏人群。激烈的市场竞争促使更多的侵权行为发生,我国知识产权法相关法律更加侧重对计算机游戏代码和运算程序的保护,对于表达层面的保护几乎无能为力。在著作权侵权行为的判定中,往往将计算机游戏拆分成程序、文学作品、美术作品、音乐作品、电影作品等多种作品分别进行判定,割裂了计算机游戏的整体性,增加了诉讼成本,也不利于游戏产业健康发展。
The video games industry has a huge market size and very large game crowd with the rapid development in recent years. Intense market competition leads to more infringement, China's intellectual property law focuses on the protection of computer game code and operating procedures, but it is powerless for the protection of expression. The court will often split video games into computer program, literary works, art works, music works, cinematographic works and so on, in the judgment of copyright infringement. It breaks the integrity of video games, raise the cost of lawsuit, even hinder the healthy develoPment of the game industry.
