摘要
检察机关的法律监督权在我国宪法与司法体制中处于重要位置,但其具体范畴在现实中尚未得到明确界定。在加强依法行政建设的过程中,应当重视检察监督权的作用。检察机关对行政权强化监督,从现实的制度框架与分工状态来看具有可行性。进一步加强检察监督,推进依法行政,应当注重完善检察监督权的理论基础,完善监督形式,加强队伍建设。
The legal supervision power of the procuratorial organs plays an important role in Chinese constitution and judicial system, but the concrete category of which is not defined clearly in reality. The role of procuratorial supervisory power should be valued in the process of enhancing the administration by law. It is feasible for the procuratorial organ to strengthen the supervision of administrative power from the reality of the system framework and the division of jobs. Attention should be paid to further strengthening procuratorial supervision and promoting administration by law, improving the theoretical basis of procuratorial supervision power, perfecting the form of supervision, and strengthening the construction of the contingent.
