摘要
WTO框架下各成员国就环境产品以清单方式进行谈判,中国提出的由"共同清单"和"发展清单"组成的"双层模式"清单,平衡了发达国家与发展中国家的利益,从法理上分析,符合共同但有区别的原则、GATT1994规则和WTO基本原则。基于"双层模式"清单的优势,完善中国环境产品清单的法律规制,扩大环境产品清单的适用范围,形成科学的动态清单,有利于实现环境与贸易的双赢。
Given that the member countries negotiate environmental goods on a list under the WTO framework,China has proposed a 'double mode'of environmental goods list,consisting of the 'common list'and the 'development list'to balance the interests of both the developed and the developing countries. From the legal analysis it conforms to the common but differentiated principle,namely the rules of GATT 1994 and the basic principles of WTO. Based on the advantages of the 'double mode'list,the win-win situation of environment and trade can be achieved by perfecting the legal regulation of China's environmental goods list,expanding the application scope of environmental products list,and forming a scientific dynamic list.
