摘要 集体所有基础上的土地产业化是农村土地集体所有与市场经济相结合的有效途径。三权分置是改革最初提出的两权分离思路的延续和发展,它有效地解决了实现土地产业化的瓶颈问题。不同于对物的所有权,产权是法定主体对开放性财产所拥有的各项权利的总和。从法律属性上分析,土地承包权是特殊的用益物权。经营性建设用地如果由集体经济组织自己经营,应该属于自用物权。如果由非所有权主体经营,则应该属于租赁权或者股权,其中股权和长期租赁权应该是用益物权。土地经营权可以是债权,也应该可以是用益物权。农村土地作为产权入股可以用土地承包经营权入股,可以用土地经营权入股,也可以用经营性建设用地入股,但是产权的性质不同,入股后的权利也应该不同。 Land industrialization is an effective way to combine rural collective land ownership with market economy on the basis of collective ownership. The three rights division is the continuation and development of the thoughts of separation of the two rights put forward in the initial period of reform, which effectively solves the bottleneck problem of realizing the industrialization of land. Different from the ownership of objects, property fight is the sum of all rights of legal subject to open property. From the legal nature, the fight of land contract is a special usufructuary right. If an operating construction land is to be operated by a collective economic organization, it should belong to private property. If it is operated by non ownership subject, then, it should belong to the right of lease or equity. The equity and the fight of long-term lease should be usufructuary right. Land management fights can be creditor's rights, and also should be usufructuary rights. Rural land as a property right can be used to buy shares from land contract management rights, land management right, also can be used to buy shares from operating construction land. However, different property fight has different nature, the right after getting shares should also be different.
