改制射钉器定性检验研究

摘要 目的进一步完善改制射钉器检验工作。方法依据射钉器的结构及工作原理,阐述改制射钉器的目的;归纳改制射钉器、自制霰弹的改制方法及结构特点;提出检验改制射钉器的要点,指出"保留枪身、使用通透枪管和借用射钉弹"是改制射钉器的共同特点并用实际案例加以说明。结果由于在一定程度上具备制式枪的特点,改制射钉器可被直接认定为枪支。结论按照相关文件规定,可将改制射钉器使用的射钉弹视为制式弹药。依据相关规定,能发射制式弹药的改制射钉器或能击发射钉弹底火的前装式改制射钉器,即认定为法定枪支。 Objective To improve the method of identifying manipulated powder-actuated tools. Method The method of manipulation, the structure of manipulated powder actuated tools and homemade shot guns are summarized. Based on the key points of identifying manipulated powder-actuated tools and illustrated with examples, the common features of manipulated powder-actuated tools can be summarized as "keeping the gun body, clearing the barrel and using the powder load". Result Due to the partial resemblance to standard firearms, manipulated powder-actuated tools can be directly identified as guns. Conclusion In accordance with the relevant regulations, powder load can be identified as standard munitions. Manipulated powder-actuated tools being capable of firing standard munitions and front-load models being capable of triggering the primer of the powder load can also be identified as guns.
