摘要
逆权侵占制度源于普通法,在国际法中亦有演变。而时效取得制度作为其英美法系中的独特制度,在维护社会公平、交易安全与物权确定上发挥了重要作用。Van Valkenburgh v.Lutz是美国著名的逆权侵占的案例,以此为基础,分析时效取得制度之构成,其对于我国现阶段物权法具有弥补空白的重要意义。
The system of reverse power encroachment origi- nates from common law and has evolved in international law. As a unique system in Anglo American law system, the acquisitive prescription system plays an important role in maintaining social justice, transaction security and the determination of real right. Van Valkenburgh v. Lutz is a famous case of reverse right encroachment in the United States. On this basis, the composi- tion of the system of acquisitive prescription is analyzed. It is of great significance to make up the blank of the property law in our country at the present stage.
