摘要
公平责任不是归责原则,只是当事人利益的衡量规则。公平责任的适用范围包括无民事行为能力人和限制行为能力人的赔偿责任,完全民事行为能力人暂时没有意识或者失去控制的行为造成他人损害和高空抛物致人损害三种情形。
Fair responsibility is not a principle of imputation, but a measure of the interests of the parties. The scope of application of fair responsibility includes the following three cases: the non-civil capacity, the person's ability restricted to act, and the full civil capacity of people temporarily without awareness or control of the behavior leading to damage to others and high-altitude parabolic damage.
