摘要
当前网约车日渐渗透我国客运市场,产生了较大的经济社会价值,但也正在威胁公共交通安全与客运市场秩序。网约车衍生的业态冲突、安全隐患、保险真空等问题亟需国家规制。立法品质不高、行政执法粗暴、司法救济缺位是我国网约车规制的现况。为此,应汲取域外网约车规制的有益经验,推动我国网约车新政的改革。为促进网约车的深度发展,我国应当提升网约车立法的品质。在政企共治模式下,运管部门需积极创新规制措施,地方政府应依法推进探索式实验。司法权对网约车的规制有待强化,我国法院应对涉网约车诉讼作出及时、公正的裁判,以形成平衡客运规制目标与网约车创新发展的诉讼政策。建构合乎法治原则与互联网思维的网约车规制体系考验着我国立法者、执法者的智识,并由此推动国家治理能力在互联网时代的现代化转型。
Now, Internet chauffeured cars are gradually spreading over the passenger transportation market, which produces great economic and social value. However, it also threatens the safety of public traffic and the order of passenger transport market. The conflict of formats, security risks, the vacuum of insurance etc, caused by Internet chauffeured cars, need national regulation. The current regulation status of Chinese Internet chauffeured cars, unfortunately, is poor in legislation quality, rough in administrative law enforcement, and insufficient in judicial relief. The beneficial experiences in the United States, Britain, Germany and France could contribute to the reforms of regulating Internet chauffeured cars in China. China should improve the quality of regulations on the Internet chauffeured cars. Based on the cooperation pattern between government and enterprises, the traffic administration department should be innovative in creating regulatory measures, and the local government should legally boost exploratory experiments. The judicial regulation of Internet chauffeured cars should be strengthened. Chinese courts need to make judgment on Internet chauffeured car timely and fairly, in order to form lawsuit policies that balance the regulation goal of the passenger transportation market and the innovative development of Internet chauffeured cars.
