摘要
共同海损行为的合理性要件是《约克-安特卫普规则》的首要规则。关于合理性的标准有主观标准与客观标准。海事审判实践中主要是依据客观标准,文中结合海事公约、航运实践等提出了主客观相统一标准。
Rationality, as an essential condition for general average acts, is the prhmary principle of the York-Antwerp Rules. Currently, there are two standards for detemining the rationality of general average acts, i.e. the subjective standard and objective standard. The objective standard widely applies to maritime cases. The paper, however, reconunends the standard with the unification of both the subjective and objective standards, taking into consideration relevant marithne conventions, shipping practice, maritme cases and etc.
