摘要
文章认为我国现行农村征地生态价格补偿标准的缺失、相关法律和制度的缺失、相关职能体系的缺失,侵害了被征地农民和地区的生态利益,造成土地开发的经营更加粗放,导致各主体利益出现矛盾。应该通过引入农村征地生态价格补偿立法、构建农村地区生态环境监测体系、制定合理的区域化征地生态价格补偿标准、形成直接与间接相结合的多样化补偿方式等措施,实现对被征地农民的生态补偿,最大限度地保护被征地地区的农村生态环境不受破坏。
In present rural land requisition of China, there are problems such as the lack of price compensation standard, the lack of relevant laws and regulation and the lack of function system. Those problems harm farmers＇ ecological interests and land acquisition area, make the land development business become more extensive, leading to the interests of the subject of conflict. Therefore, we should introduce land ecological Compensation price, construct rural ecological environment monitoring system, establish regional land ecological compensation standard price, form diversified compensation way and other measures, so as to achieve the ecological compensation of landless farmers, to maximize the protection of the ecological environment in rural areas.
