摘要
版权法上技术措施有两类,一类是保护版权的技术措施,一类是保护接触的技术措施。版权法上技术措施必须是用于保护作品、表演、录音录像制品及广播信号等版权法的客体,但技术措施所限制的行为并不一定与侵害现行版权法规定的专有权利相关联。"接触"是利用作品使用价值的行为。对文字作品的接触是"阅读",对影视作品的接触是"观看",对计算机软件作品的接触是"运行"。数字作品的特点决定了应重点保护接触控制措施;现行版权法对版权保护措施已有保护途径,版权法保护的技术措施应主要针对接触控制措施;在版权法未将接触权规定为专有权利时,版权法的变革也要求版权法在保护技术措施时应重点保护接触控制措施。
Technological measures in copyright law consist of measures that protect exclusive rights and measures that control access.All technological measures in copyright law are used to protect copyrighted subject matters,such as works,performances,phonograms,broadcast signals and so on.However,actions restricted by technological measures are not limited to those infringing exlusive rights protected by existing copyright law.Access is a behavior to exploit the value in use of a copyrighted work.Access to a literary work means to read it.Access to a visual-audio work means to see and listen to it.Access to a software means to run it.The characteristics of digital works decide that the priority should be given to access control measures.Since it has already been possible to protect technological measures that protect exclusive rights via existing copyright law,protection provided by copyright law to technological measures should focus on measures that control access.And given that access right is still not one of the exclusive rights in traditional copyright law,the development of copyright law requires that protection given to technological measures should lay more emphasis on access control measures.
