摘要
司法公信是指社会公众对司法主体及其行使司法权的信任,司法公信程度与司法权的运行、司法权威、法律的实施等密切相关,提升司法公信力是法治中国建设的重要内容。司法公信受到诸多因素的影响,比如司法主体的素质、司法权运行及监督机制、司法体制、社会诚信状况等。提升司法公信、维护司法权威,必须以司法公信的影响因素为基础,针对性地提出改革举措,其根本内容是以司法公开、公正为导向,建立起以公开、公正促公信的实现机制。
Judicial credibility refers to the public＇s trust in the judicial subject and its judicial power. The degree of it is closely re-lated to the operation of judicial power, judicial authority, the implementation of the law,so enhancing the degree of judicial credibility is an important part of China＇s rule of law.Judicial credibility is affected by many factors, such as the quality of the judicial subject,the judicial power operation and supervision mechanism, the judicial system, social integrity and so on. To enhance the judicial credibility and maintain the judicial authority, we must put forward the reform measures on the basis of the influencing factors of the judicial public trust. The fundamental content of the reform is based on judicial openness and justice as the guide, to establish a mechanism which can promote judicial credibility according to judicial openness and justice.
