摘要
学术自由作为一种权利,既不是与生俱来的,也不是上天恩赐的,必须通过理念的支持和实体的斗争而获得。时代在变革,大学在发展,作为大学办学理念的学术自由也不断变迁,中世纪大学的学术自由在理念支持、内涵和困境方面都不同于现代大学的学术自由。然而从中世纪到现代,自由之理念一直是学术自由的合法性来源,大学自治是保障学术自由的根本制度,这两者任何一方存在问题,学术自由就深陷困境;现代大学要突破学术自由的困境应从这两个方面着手:一手抓人文环境建设,一手抓制度环境建设。
As a kind of right, Academic freedom is not inherent, nor as a gift from God. It must be obtained through the support of ideas and the struggle of the entities. As times are changing and the Universities are developing, academic freedom as the idea of u- niversity is also changing. The idea, connotation and dilemma of academic freedom in the medieval times are different from modem times. But from the medieval times to modem times, the idea of freedom has always been a legal source of academic freedom and uni- versity autonomy has always been a fundamental system to protect academic freedom. If one of them gets into trouble, academic free- dom will be in deep trouble. Modem university should start from these two aspects to break through the trouble. Both the human envi- ronment and the system environment should be constructed.
