摘要
近些年来,为了拓展公民行动的范围和领域、深化民主的程度,民主研究发生了审议转向。审议民主欲将公民的"普遍同意"视为民主实践的正当性基础,并试图通过公共论证的途径来寻求公民的"普遍同意"。然而,随着公民个人权利的不断成长和丰富,有必要将民主实践的正当性基础置于公民的"普遍满意"之上。对承担着治理职能,扮演着治理角色的民主实践来说,寻求令公民感到"普遍满意"的方案比规划令公民感到"普遍同意"的公共论证更根本。
In order to expand the scope of citizens' actions and deepen the degree of democracy, there is a deliberative transition of studies on democracy and democratic practice in recent years. Deliberative democracy is generally consensus-oriented which takes ‘universal consensus' as fundamental legitimacy of democratic practice and seeks citizen's universal consenting to specific issues through public argumentation. This paper argues that the legitimacy of democratic practice should be placed on ‘universal satisfaction' from the public along with the increased public consciousness and awareness of individual rights, it 's much more fundamental to pursue a ‘generally satisfied' proposal than planning for a consensus-oriented public argumentation in democratic practice which plays key roles in governance.
