摘要
在深度链接基础上发展起来的视频聚合服务,已成为当下著作权法领域最受关注的商业模式,理论界和实务界就"聚合链接应当如何定性"的问题展开了激烈的辩论,观点鲜明且对立。如果紧扣聚合链接的技术本质,那么自然会认为设链者至多构成著作权间接侵权;但如果紧扣问题的本质——著作权的边界——来定性聚合链接,设链者则有可能构成著作权直接侵权。由此可见,聚合链接的定性问题反映了著作权直接侵权与间接侵权的界分,但在当前的诸多探讨之中,更为根本的著作权的本质与边界问题常常被忽略了。
Video aggregation service,which is developed on the basis of the development of in-line link,is the business model that attracts the most attention during these days in the field of copyright law.Lots of specialists from theory and practice fields are engaged in the fierce debate about the issue of how to conduct qualitative on aggregated link,which is opinionated and opposition.Focusing on the technical nature of the aggregated link,link service provider is naturally thought to constitute up to the indirect copyright infringement.But,the provider will be thought to constitute the direct copyright infringement if we consider this issue on the basis of the nature of copyright.Thus it can be seen,the qualitative issue of aggregated link actually reflects the delimitation of the direct and indirect copyright infringement.But among the current discussion,the nature and boundary of copyright,which is the more fundamental problem,had been always overlooked.
