摘要
从业禁止制度是我国刑事制裁方法的一种拓展和创新,预示着我国刑法处罚措施的功能转型和结构转化。该制度的积极意义在于以行为人的人身危险性为基础进行犯罪预防,有异于资格刑的法律特征和报应目的,也有别于非刑罚处罚的适用程序和功能实现,在本质上更符合保安处分的适用条件和法律后果。从业禁止的增设昭示保安处分刑法化的立法倾向,有利于刑事制裁多元化的实现,可以弥补劳教制度废除后所体现的功能缺失,也是从正当程序保障人权、规范保安性措施的客观需要。
As a development and innovation of criminal sanction, the employment prohibition system indicates functional transformation and structural transformation of Chinese criminal law pen- nalties. Based on the judgement of the offenders7 dangerousness, the system can be used for crime prevention,which is its positive significance. It is different from the qualifications penalty in legal characteritics and the purpose of punishment, also different from the non-penalty punishmenfs appli-cable procedures and functions. According to the conditions and consequences of the employment prohibition system,it is more in line with security measures in essence. The additional system ,which declares the tendency of security measures to be crminal law measures, is conductive to the diversifi-cation of criminal sanctions. It can make up the insufficiency of criminal sanctions after the abolition of education through labor system, is the objective need of the protection of human righs and the specification of security measures from the due procedure as well.
