摘要
当前正在推进的以整合地方工商、质监、食药监等部门职能为核心的市场监管体制改革,在取得明显成效的同时,也集中暴露一些亟待解决的行政法治难题。为更好推进改革进程,首先要做到改革于法有据,并完善改革的顶层设计方案;二是要规范机构设置,明确市场监管部门职权行使边界;三是要同步推进相对集中复议权改革,防止在市场监管体制改革过程中出现行政复议不作为现象。
The reform of market supervision system, taking the integration of functions of local industrial and commercial authorities, quality supervision and food ＆ drug administration as the core, has achieved remarkable results while facing some urgent administrative and legislative difficulties. In order to better promote the reform, we must first carry out reform according to law, and improve the top-level design program of the reform; standardize the organization structuring and define the power boundary of the market supervision authority; and simultaneously promote the reform of relative concentrated reconsideration right, to prevent the administrative reconsideration omissions in the reform of market supervision system.
