摘要
从慈善与道德的关系来看,慈善参与中的道德风险根源于其道德属性,并且是客观存在的。慈善参与中的道德风险是指在慈善参与中,慈善行为主体本身的可能道德行为的不确定性,慈善行为本身的表达在某种意义上具有相当的不确定性。造成这种道德风险产生的现实复杂因素包括慈善参与者的身份、社会公众对慈善的认知、监管机制、媒体报道等。这种道德风险对捐赠者与受助者、慈善的公信力乃至整个社会都产生严重危害。慈善参与中道德风险的治理路径有培育现代慈善理念、完善相关法制、端正慈善参与者自身的慈善行为、扶正大众媒体的舆论导向等。
From the relationship between charity and morality, moral risk in the charitable participation rooted in the moral nature. The moral risk is the objective existence .The moral hazard in the charity, participation refers to the uncertainty of the moral behavior of the main body of the charity itself, and the expression of the charity itself in a sense. The reality of the moral hazard traused by the complex factors including the identity of the charity, the public awareness of the charity, the regulatory mechanism, media reports, etc.. The moral hazard of donors and recipients, the charity＇s credibility and the whole society has serious harm. The governance path of moral hazard in the charitable participation has the cultivation of modem charity idea, perfect the relevant legal system, correct the charity behavior, and the direction of public opinion.
