摘要
本文通过对2010年-2015年高教领域300多起诉讼案件的分析,发现我国高教领域诉讼案件数量逐年增长,争议范围逐步扩大,高校与师生间的纠纷为主要类型。高校管理中存在着自制规章制度不合法或适用不当、权力行使程序不规范、忽视积极履行信息公开法定义务等问题。高校应重视诉讼案件,从认识、制度和程序等方面进一步提高依法治校的水平。
Through analysis of more than 300 tawsmts concerning nl^t.ct cuu,~authors conclude that lawsuit numbers in higher education increase annually, the scope of controversy expandgradually, and disputes between higher education institutions （HEIs） and teachers ＆ students are the mostprevalent form among all. Problems of the rule of law in HEIs are identified as follows： self-developed regulationsand systems in conflict with statutes on student management issues, lack of standardized procedure for powerexecution on teacher management issues, and failing to actively fulfill the legal obligation of information disclosure.HEIs are supposed to attach importance to lawsuits and enhance the level of rule of law from the perspectives ofidea, institution and procedure.
