摘要
农民政治参与实质是一种利益诉求表达,无论是制度化的还是非制度化的,是合法的还是非法的,都在客观上改变了农村治理的政治生态和法治生态。其对农村治理法治化的影响表现为农民政治参与改变了农村基层治理传统,倒逼了基层政府依法行政,推动了村民自治的法治化。以此为视角,从利益诉求的法治化表达和矛盾纠纷的法治化化解出发,农村治理法治化的路径需要创新治理机制,营造农民政治参与的法治生态;严格法律实施,引导农民通过合法途径表达利益诉求;加强农村普法,引导农民运用法治方式解决矛盾纠纷。
Peasants＇ political participation is the expression of benefit and changes political and legal ecology no matter institutional or non - institutional, legal or illegal. The influence of peasants＇ political participation reflects the changing the tradition of rural grassro- ots governance, forces grassroots to execute right according to the law, and pushes legislation of villagers＇ autonomy. From this aspect, the essay starts with legal expression of benefits and legal solution of conflicts. The ways of realizing management legalization in the countryside are as following： innovate governing system ; create legal ecology of peasants＇ political participation; execute law strictly; lead peasant to express requirements and benefits through legal ways; strengthen rural law popularization; and let peasant solve prob- lems through laws.
