摘要
国际项目融资中往往涉及土地问题,如何避免和解决国际项目融资中的土地争端,已经受到各个国家、投资方、项目所在地的社群还有国际组织的高度重视。2014年柬埔寨金边国际机场征地项目案更为国际社会所高度关注。本文主要分析受理此案的世界银行独立的投诉问责机构——合规顾问/监察专署(CAO)对本案争端的独特解决程序和处理依据,并以此为根据,研究国际项目融资中相关的土地争端问题的特殊性,以及解决国际项目融资中土地争端的新途径和新空间。
Land issues are often involved in international project financing,how to avoid and solve the land disputes in the international project financing, has received great importance by various countries, investors and the community and international organizations the project located in.Cambodia Phnom Penh International Airport land acquisition project is more concerned about the international community.This paper mainly analyzes the admissibility of the case of the world bank＇s independent complaint accountability office CAO＇s unique solution to this case dispute and the basis for processing, and based on this, research on the particularity of the land dispute in international project financing,As well as new ways and new space to solve the land disputes in international project financing.
