摘要
学术期刊出版协议学术不端追责功能源于学术期刊学术不端追责权的民事权利基本法律属性。出版协议可以为学术不端追责权的存在和实施提供合法依据;可以弥补学术不端行为界定的缺失;可以赋予学术期刊调查取证权;可以形成或获取、固化证据;可以约定双方保留证据的责任,预防法律风险。出版协议还可以对学术期刊的追责活动予以限制,防止权利的滥用。
The academic journals misconduct function of academic publishing agreement originates civil rights basic law attribute of the academic journals misconduct right. Academic publishing agreement can provide reasonable basis for the existence and implemintation of accountability of academic misconduct, make up for the lack of the definition of academic journals misconduct which plays a decisive role in the formation, acquisition and fixation of evidence. Academic lishing agreement can also retain the duties to prevent legal risks. Meanwhile, academic publishing agreement can t the accountability of academic journals to prevent the abuse of right.
