摘要
本文叙述的是原告单位的一批技术人员跳槽后成立了新的公司,生产与原单位同类的冷加工机械产品,并在离职后一年内将其在原单位的职务发明申请专利,其中部分专利与发明人在原单位完成的技术方案基本相同,另有部分技术方案作了改进。经过审理,法院认定其中基本相同的技术方案属于职务发明,而对作了改进的技术方案则以"部件、结构、所要解决的技术问题均不相同,不能……认定两者体现的技术方案有关"为由认定为非职务发明。本文中笔者比较详细地叙述了该专利权属纠纷的代理思路、诉讼策略及判决结果。
This paper describes a group of technical personnel who are formal employees of the plaintiff, left the company to set up a new company which produces cold processing machinery products that is similar to the products of their formal employer, and within one year after resigned from their original company they applied patent for their formal employee invention in which part of the patent and the inventor are basically the same, and some other technical solutions have been improved. After the hearing,the court finds the technical scheme of the invention is basically the same, and to technical improvements,the court finds that these parts are not employee invention, based on that the components, structure,technical problem targeted are not the same, the two technical scheme is not to be considered related. In this paper, the author gives a more detailed description of the train of thoughts on this patent ownership dispute, litigation strategies, and the verdict.
