摘要
完善人民陪审员参审机制有助于提升人民陪审员参与庭审的质效,进而推进司法民主,促进司法公正,提升司法公信力。人民陪审员参审机制既要确保人民陪审员"当家作主",又要引导人民陪审员公正裁判以预防"失控的陪审员"。因此,完善人民陪审员参审机制,应在保障公民依法行使民主权利的基础上,努力实现实体公正和程序公正。具体包括:构建以证据评价为基础的事实认定模式,优化参审案件的范围和人民陪审员在合议庭中的组成比例及选任模式,完善法官指示规则和合议庭评议表决机制。
The quahty and effect of court hearing and decision tried by the people＇s assessors is closely related to the success of the people＇s assessors＇ system reform.The improvement of people＇s assessors＇ participation in trial would enhance the people＇s jury trial quality and efficiency,and promote the judicial democracy,justice and public credibility.The improvement of people＇s assessors＇ participation in trial should promote the people＇s jury substantive trial but also prevent people＇s assessors from ineonformity with the law.Therefore,we should as soon as possible to implement the transformation of the assessor authority,optimize the scope of people＇s assessors,give parties procedure start right and people＇s assessors option,strengthen the judge instructions mechanism and improve the mechanism of the collegiate bench appraisal.
