摘要
书证的证明力由两部分构成:形式证明力和实质证明力,前者指书证与某人存在特定的联系,后者指书证的内容对案件事实产生某种效果。电子数据在很大程度上和书证一样,都是由载体和内容构成,且都以其表达的思想内容来证明案件事实。因此,可以参照书证证明力的分类,将电子数据的证明力也分为形式证明力和实质证明力。电子数据的形式证明力,是指电子数据真正成立之时所存在的证明力,主要解决的是电子数据的真实性问题。电子数据的实质证明力,是指电子数据的实质内容对案件事实证明作用的大小,主要解决的是电子数据的关联性问题。电子数据的形式证明力、实质证明力与其证据能力都有着本质的区别。电子数据的审查判断主要经过三个阶段:证据能力—形式证明力—实质证明力。
Documentary evidence to prove force is composed of two parts:formal proof force and substantial proof force.The former refers to the card and someone has specific contact.The latter refers to the card to the facts of the case,have some effect.Electronic data in a large extent and documentary evidence are composed of carrier and content and to express their ideas to prove the facts of the case.So we can reference documentary evidence to prove force classification,the probative force of electronic data also form the force of evidence and proof of substantial force.In the form of electronic data,it is proved that the electronic data is true,which mainly solves the problem of the authenticity of electronic data.The substantial proof force of electronic data is the magnitude of the effect of the substance of the electronic data on the facts of the case,which mainly solves the problem of the correlation of the electronic data.The form of electronic data has the essential difference between the form of the force,the substantial proof force and the evidence ability.The examination and judgment of electronic data mainly go through three stages:the ability of evidence,the form of proof,the substantial proof force.
