摘要
目的本文通过阐述对一家公共浴室的违法行为实施行政处罚的办案要点,为今后卫生行政部门查处公共场所违法行为提供借鉴。方法通过对该案进行案情分析、办案点评,并将重点延伸到几个常见疑难问题的探讨。结果该案在办理过程中程序合法、事实清楚、证据收集全面、主体认定准确、自由裁量适当。结论卫生监督员要加大对公共场所违法行为的查处力度,且在实施行政处罚时要严格按照法定的职责、程序执行。
Objective To implement an administrative punishment to illegal acts of a public bath, elaborate the key points in the management process of this case, and offer reference for health administrative department investigating and treating the illegal acts of public places in future. Methods To do a condition analysis and transaction review of this case, and extend the key point to several common and knotty problems＇ discussion. Results This case＇ s process was legal, fact was distinct, evidence collection was comprehensive, subject identification was correct, and discretion was appropriate. Conclusion Health supervisors should enhance the investigation and treatment to illegal acts in public places, and implement the administrative punishment according to the legal responsibility and procedure stringently.
