摘要
通过规制作为网络言论的域名和作为网络言论门户的域名就可以高效地控制网络言论的自由传播。本文通过以下三个方面分析我国域名管理制度如何影响网络言论自由:一是网络域名与网络言论的关系;二是管理全球域名系统的ICANN制定的UDRP在处理域名与商标纠纷时的裁决倾向对网络言论全球保护的影响;三是《中国互联网络域名管理办法》(2004年)对域名注册程序的规制方法,对域名注册管理机构和域名注册服务机构的控制方式。经过理论分析和实证数据的支撑可知,中国顶级域名管理制度通过对域名注册程序的控制,通过对域名注册管理机构和域名注册服务机构提供的域名解析服务的控制,以掌控网络言论在境内和境外间或在境内间的自由传播。因此,掌控了规制域名系统的权力就掌控了对网络言论进行规制的权力。
Through governing the domain names as the cyberspace speech and as the gateway to cyberspace speech, it could be a high effective way to control the free dissemination of cyberspace speech. That how the Chinese administrative regulations of the . cn ccTLD has an impact on the dissemination of eyberspace speech in China is analyzed via the three aspects：（ 1 ）the relationship between domain names and cyberspace speech ; （ 2 ） the influences of panel decisions, solving disputes between domain names and trademarks according to the UDRP issued by the ICANN, on the global protection of cyberspaee speech ; （ 3 ） the ways that the Administrative Measures on China＇ s Domain Names （AMoCDN） released in 2004 govern the registration procedure of domain names and the domain name resolution service provided by domain name registries and registrars, to control the free dissemination of cyberspace speech between domestic and international or among nation. After the theoretical analysis and the support of empirical data, it can be concluded that the AMoCDN has restrained the freedom of cyberspace speech in mainland of China via the constraints exerted on the domain name registration procedure and resolution service. Therefore, who has the power to control DNS will have the power to govern cyberspace speech.
