摘要
商事仲裁案件的裁决较之法院判决通常会更具个性化，不追求制式统一，更加关注个案中的合理性。但研究商事仲裁裁决的共性，以归纳出的商事仲裁裁决的六要素作为思维起点，有助于提高裁决书制作的效率。六要素包括：合同的效力、请求的依据、履约的证据、损失的酌定、主文的处理、程序的完善。
Compared to the court judgment, the arbitration award is usually considered with more personalized features. The writer of the arbitration award shall not focus on the pursuit of uniform standards, while concentrate on reasonability in the case at the same time. However, if we research on the commonality of commercial arbitration award and take The Six Elements of the Commercial Arbitration Award as the starting point of thinking, it will be helpful to improve the efficiency of the award production. The Six Elements of the Commercial Arbitration Award include： the validity of the contract, the basis of the request, the evidence of compliance, the discretion of loss, the of expression main text, the correctness of procedure.
