摘要
长期以来,我国法学界对警察权的规制问题没有达成共识。支持警察权外部规制的观点似乎多于内部规制,但实践证明不论是外部规制还是内部规制,对于警察权而言均无法独立地实现有效规制。因此,警察权外部规制和内部规制的关系问题日益受到法学界的关注,两者的互相补充、互相促进以及相互协调将会对我国警察权规制问题的探究提供一个更加全面、更加科学、更加合理的思路。
For a long time, China＇s law circle has no. agreement on the regulation of police authority. The views supporting external control seems to be more than those for internal regulation, but practice proves that both the external control and internal rules and regulations for the right of the police were unable to effectively control independently. Therefore, the problem of the relationship between external control and internal control of the police authority by law is getting more and more attention.The two above supplement each other, promote each other, and coordinate with each other.It will provide a more comprehensive, more scientific and more reasonable train of thought for the issue of the regulation of police authority in China.
