摘要
逮捕后羁押必要性审查是我国刑事司法的一项重要制度创新,但在司法实践中却由于认知误区以及制度设计的不尽合理导致未能彰显预期效果。未来在制度定位方面,应当将检察机关的逮捕后羁押必要性审查权视为其批准和决定逮捕权的自然延伸;在审查主体方面,应当实行羁押必要性审查的统一归口管理,由检察机关的侦查监督部门负责作出逮捕决定以及在逮捕后继续进行羁押必要性审查;在审查程序方面,应当重新规范羁押期限并且将羁押必要性审查从不定期审查转为定期审查,明晰强制措施功能并且在审查证据要件和刑期要件的基础上侧重审查社会危险性要件,逐步扩大采行听证方式进行审查的案件范围,赋予检察机关直接解除羁押措施的权力。
The necessity of censorship system for arrest detention was an important innovation in China's criminal proceedings, while it had not reached its expected effect for cognitive mistakes and the unreasonable system design. This system need to be adjusted in many ways. For the censorship power on arrest detention, it should be deemed as a natural extension of the power of approvalto arrest. For the censorship subject,the necessity of censorship onarrest detention should be attributed uniformly to the investigation and supervision department of the Procuratorate. For the censorship procedure,the detention term should be re-regulated,the periodical censorship should be switched to review from time to time,more attention should be put on the detainees' danger to society on the basis of evidence,prison term and the function of coercive measures,hearing method should be gradually expandedto more cases,and the power to directly remove the custody measures should be given to the procuratorial organs.
