摘要
错案是错案责任问责的前提和基础,正确界定错案的概念、确立统一的错案认定标准,对于正确追责以及防范错案的发生具有积极意义。在错案标准的设定上,要坚持协调性原则,协调好公众视野下的正义观与司法正义观之间的关系,以两种正义观的交集部分为基础,在倾斜于司法正义观的过程中适度兼顾"民意";同时也要坚持等级化原则。错案概念与错案标准作为错案认定问题的"一体两面",只有相互融会贯通才会推升错案研究的成效,并借此夯实错案的预防。
Misjudged case is the prerequisite and foundation of the accountability of misjudged case. It is of positive significance for correcting the responsibility of wrongdoing and preventing the wrong case to correctly define the concept of misjudged case and establish the cognized standard of misjudged case.
