摘要
3D打印技术自身所具有的突破性特点将会对建立在社会分工与集中化大生产为基础上的专利制度产生一定的冲击。专利审查制度作为专利权获得的基础,在专利审查检索资料的范围、专利审查检索技术和专利审查效率三个方面存在一定的不适应性。鉴于当前我国3D打印技术产业化发展的现状和专利审查制度的实际需求,虽然我国专利审查制度目前尚无修法之紧迫性,但是应持积极态度前瞻性地进行研究并在立法层面、技术层面和效率层面进行完善,以适应将来我国3D打印产业发展需要。
The breakthrough characteristics of 3Dprinting clashes with the patent system,building upon the division of labor in society and centralized production.As the foundation of the patent right,patent examination will face the challenges from the three different aspects,which are the scope of research information in patent examination,the research tools in patent examination and the productivity of the inspectors.According to the developing situation in 3Dprinting industry and actual requirement of patent examination in China,though the patent examination system does not need to be rectified right now,the government should hold positive attitude to prospectively analyze the problems,improve in the legislation,technology and efficiency in order to adapt to the our country＇s industry development of 3Dprinting.
