摘要
公立高校章程对学校与政府举办者关系的规制,是彰显章程外部法律约束力、构建和谐政校关系、推进法治政府和高等教育治理能力现代化建设的需要。从章程文本实证分析来看,部分公立高校章程对学校与政府举办者关系进行了规定,但相关规定还存在着行政化倾向明显、权利义务内容不完整、争议解决机制缺位、法律责任制度缺失等问题。我国公立高校章程应完善文本规定,以明确学校与政府举办者关系的章程规制,强化政校关系和谐发展的制度保障,推进现代大学制度建设。
The regulation of public university constitution between public university and government sponsor is the need of external legal’s binding force, harmonious relations’ construction and management ability’s modern-ization of government on the rule of law and higher education. From the empirical analysis of public university constitution text, some of them have cleared the relationship between public university and government spon-sor, but there are some problems about the regulation that tendency of the relevant provisions is too obvious, the contents of the rights and obligations are incomplete, the dispute settlement mechanism is absent, and le-gal responsibility mechanism is defective. The public university constitution in our country should take effec-tive countermeasures to improve the text in order to optimize the relationship regulation between school and government sponsor and promote the construction of modern university system.
