摘要
司法机关在回应社会需求时,应当使其制度变革具有正当性。正当性涉及合法律性、合宪性和正当性三个层面。就司法机关最近积极推广的司法建议而言,在合法律性方面,司法建议在建议内容、适用对象、适用条件上已经超越了《民事诉讼法》与《行政诉讼法》的制度预设;在合宪性方面,司法建议存在可能侵越立法权、模糊行政权与司法权权力分工、偏离司法机关审判权能等影响宪法确定的权力结构的问题;在正当性方面,司法建议使司法权保护少数的立场弱化、民主立场被过度秉持,同时,也使司法权承受主动而开放的知识管理风险,这些问题已经背离了司法权性质。因此,司法权可以以自己的方式为社会发展作出贡献,但司法建议并非合适手段。
When it is widely used to strengthen the administration and management and other issues, judicial proposal need to face the problem of its legitimation. Legitimation involves three levels, that is, legality, constitutionality and legitimacy. In the level of legality, judicial proposal is beyond the purpose of Civil Procedure Law and Administrative Litigation Law completely on the content, scope and procedures; on the constitutionality, judicial proposal may violate the borders among legislative, executive and judicial powers, and then destroy the constitutional structure. As far as legitimacy is concerned, judicial proposal has deviated from the nature of judicial power. Judicial power should protect the minority, not directly on behalf of the majority; should abide by the law strictly, not be connected with democracy directly; should be passive, but not active and open. The courts can contribute to the development of the society in their own way, but judicial proposal is not the appropriate means.
