摘要
互联网金融背景下,股权众筹不断发展。中国在借鉴发达国家的有益尝试的基础上,应当在现行法律框架内,为股权众筹的发展松绑减缚。对于投资人地位的规定,应当相对放开,面向普通公众投资人,同时确立一个相对较低的投资数额标准。确立领投人的法律地位,完善相应的制度设计,防范道德风险,促使股权众筹沿着合法有序的方向发展。
equity-based crowd-funding continues to develop against the backdrop of internet finance.Upon learning from the good practices of developed countries,China shall relax the policies to give space for equity-based crowd-funding.Stack policy shall be made concerning position of the investor,including the general public investors and on a relatively smaller amount of investment.Set up the legal position of the leading investor.Improve the system design.Prevent moral hazard.Guide equity-based crowd-funding to develop on a legal and orderly direction.
