摘要
体系解释是一种在系统思维指导下的解释方法。体系解释属于实质的解释方法,属于为论证提供支持的解释理由。从体系解释的角度分析,需要对入户抢劫予以限制认定。应当分别从"入"的主体、目的、手段三个方面对其进行限制认定。进行体系解释时,既要符合罪刑相适应原则,同时又不能违背罪刑法定原则。抢劫罪中的"入户"与盗窃罪中的"入户",在性质上并不相同,因此认定上也要具体问题具体分析。
Systematic interpretation is a substantive evidence under the guidance of systematic thinking. According to systematic interpretation,burglary can be identified from its subject,purpose,and means. Such interpretation will comply with the principle that the punishment fits the crime without breaking the principle of legality. For example,burglary is different from robbery and therefore they should be identified in different ways.
