摘要
促进专利应用是本次专利法修改的目的之一。促进专利应用,首先就要求协调好专利权人与专利使用人之间的关系。专利先用权人就是具有特殊意义的专利使用人,如果将专利使用人从申请时间划分为在先使用人与在后使用人的话,专利先用权人正是专利技术的在先使用人。可见,协调专利权人与专利先用权人之间的关系同样十分重要。构建专利先用权证制度,在分析制度依据的基础上,就先用权证内容、取得方式等进行界定,有利于定纷止争。
One major purpose of the current Patent Law revision is to promote patent application. To that end, a very important thing is to coordinate the relationships between the patentee and the patent users. Patent users can be divided into two groups, prior users and posterior users, based on the patent application time. Therefore, it is also important to coordinate the relationships between the patentee and the prior users. The paper suggests constructing the patent prior user certificate system, with an aim to reduce the disputes. Moreover, it also discusses the definition of the content and methods of acquiring the certificate, relying on the analysis of the institutional basis.
