摘要
外观设计在专利失效后可能面临著作权、商标权、知名商品特有的包装装潢的多重保护。市场机制本身已经认可了外观设计的多重保护,并且多重保护并不妨碍竞争,招致诉讼。然而,不能无限扩大权利保护冲突的范围,应当在有限的权利空间下对权利冲突进行调和。具体而言,著作权的保护应当被排斥在以原有外观设计专利权使用的形式之外,仅在单纯的著作权意义上使用才能形成有效抗辩。商标权的保护以未注册的驰名商标保护为主,并严格限制在同类保护情形下。知名商品特有的包装装潢的保护应当合理排除功能性包装装潢的使用。
After the design patent has expired, the design may still receive multiple protection including copyright, trademark, and rights of well-known commodity packaging decoration. The market has already recognized the multi-protection for designs; besides, multi-protection won’t impede competition nor would it incur completion-related litigations. However, the conflict between rights protection should not be expanded unlimitedly. The right conflicts should be reconciled within a limited space. Specifically, copyright protection should be denied for the use of the original design patent. That is to say, copyright defense is established only when the design is used in a pure copyright meaning. Trademark protection should primarily give to unregistered well-known trademarks, and should be strictly limited to the same category. Protection of packaging and decoration for well-known product should be denied to the functional packaging and decoration.
