摘要
国家生活层面的协商民主是社会主义民主政治的重要组成部分,其法治化管理程度关系到协商民主的深入发展水平。要积极稳妥地推进国家层面协商民主的法治化管理,进一步完善社会主义协商民主制度,必须做到经验理性与建构理性的有机结合,统筹整体推进和部分提升的辩证关系,厘清民族传统和西方经验的逻辑关联,实现立法管理和全民守法的双向互动。在这些原则的基础上,通过在立法协商、行政协商、政党协商等环节加强法治化管理,整体推进协商民主法治化管理水平。
Deliberative democracy at the national level is a crucial part of socialist democracy. Its degree of legalized management concerns its degree of development. A certain amount of actions must be taken to make the deliberative democracy at the national level achieve higher level of legalized management and improve the system itself. These actions include organic combining experience reason and construction reason,overall planning the dialectical relation between advancing on the whole and fractions,clarifying the logical relevance between national tradition and western experiences,realizing mutual communications between legislative management and the whole people law-abiding. Based on these important principles,we could improve the level of deliberative democracy＇s legalized management by strengthening legalized management in processes like litigation consultation,administration consultation and parties＇ consultation.
