摘要
知识产权法中的公共利益,可以区分为基于市场逻辑的公共利益与补充市场逻辑之不足的公共利益。前者如充分有效地保护知识私权,后者如为保护生命权、健康权和受教育权等对知识私权加以适当限制等。知识产权法的公共利益理念,首先表现为知识产权法的立法目的;然后借由立法目的,构造为确认公共利益的知识产权法的原则,如知识私权神圣原则、激励创新原则、公平原则等。但知识产权法对公共利益的接纳与保护,最终主要通过具体的、操作性的法律规则的设计与实施而得以实现。在国际贫富差距不断拉大、文化多样性和生物多样性消减加剧、全球气候变暖增快、数字技术深刻改变知识创造与使用模式并创造新的商业模式的时代,知识产权法需要认知、发掘、回应、保护新的基于市场逻辑的公共利益与补充市场逻辑之不足的公共利益,并做出相应的制度调适。
The public interests in intellectual property law,may be defined into two sorts of public interests: the first one is public interests based on market logic,such as protecting the intellectual property sufficiently and effectively; the other is public interests supplementing the market logic's shortage,such as limiting intellectual property in order to protect life right,heath right and education right. The idea of public interests in intellectual property law is reflected by purpose of intellectual property law,and then its principles of public interests,such as private intellectual property is sacrosanct,innovation encouraging, and fairness principles. But to protect and realize public interests,we must make specific law rules and enforcing such rules. At the time when the difference between international poverty and richness has been enlarging,cultural diversity and biodiversity has been decreasing rapidly,globe has becoming warm slowly,digital technology has changing knowledge-making and knowledge-using and making new business mode,we need in intellectual property law to recognize,find,respond,protect new public interests,based on market logic and the one supplementing the market logic's shortage,and reorganize some law rules.
