摘要
环境民事公益诉讼作为解决环境污染纠纷的现代型司法解纷机制,维护社会公益的特性决定了调解制度的运用必然有别于普通民事诉讼。从不同的诉讼请求维度探讨公益诉讼调解的内容与限度,有助于理清环境民事公益案件在实体请求层面如何适用调解。对当事人处分权进行必要限制、在发现案件真实的基础上启动调解,调解结果必须经过审查与监督是公益诉讼调解特殊的程序品性,决定了调解在启动、进行、调解书的形成等方面有着特殊的程序安排。立法应进一步完善环境公益诉求的具体类型,强化事实清楚、分清是非的调解原则,在引导民众有序参与调解,充分审酌环境保护主管部门意见的基础上形成调解协议,并完善调解协议的公告程序、法院审查处理方式及调解书的公开途径,以真正实现公益保护的要求。
As the modern judicial conciliation mechanism to solve the environmental pollution dispute,the Civil Litigation for Environmental Public Interest has the feature in maintaining social welfare. This feature determines that it differs in using its conciliation procedure from the ordinary civil lawsuits. To discuss the contents and limitations of conciliation from different dimensions of the claims can help people know how to use conciliation at the claimant level. The characteristics of putting forward some limitation on the parties＇ disposition,starting conciliation on the basis of finding the truth,and get the conciliation result after the review and supervision determines the conciliation of the public interest litigation has its specific procedure in starting,proceeding,and the formation of the conciliation statement. Current legislation and judicial interpretation should further perfect the types of public interest litigation,intensify conciliation principles of setting the facts straight and discerning between right and wrong,fully consider the suggestions of environmental agencies,lead people join in the conciliation orderly,and eventually form the agreement which can meet the requirements of public interest protection. It should be perfected in announcement procedures of conciliation agreements and the handling of court review. It also should clear on the way of announcement of conciliation documents.
