摘要
边境地区外国人1犯罪作为边境问题之一,以其暴力、复杂、突发、频发等特征著称,严重破坏边境人民的生活安宁,影响之恶劣不言而喻。着力研究边境地区的犯罪状况,寻找应对其逐年上升趋势的原因和对策,是涉及我国法制建设进程、稳边控边工作与国际关系局势的重大问题。建立涉外刑事被害人救助制度,是刑事诉讼人性化的要求,是社会和谐的需要,也是社会正义的需要。随着涉外刑事被害人救助制度的建立和完善,对刑事被害人权益保护也会逐步得到加强,这对于在刑事诉讼中处于弱势地位的被害人的利益维护,对于社会的稳定和发展,无疑都具有重大意义。
As one of the border problems, crimes committed by foreigners in border areas have destroyed the peaceful lives of border citizens and have noticeable bad influence with its features like violence, complicity, unexpected, frequency and so on. It is a great issue relating to our legal construction process, the stability of border control and the situation of international relations to analyze the state of crime in the border areas and find out the increasing trend causes and countermeasures. It is the needs for humanization of criminal proceedings, social harmony, and social justice to construct the form of foreign victim assistance system. With the establishment and improvement of foreign criminal victim assistance system, the protection of the criminal victims’ interests will be strengthened gradually, which is undoubtedly significant for protecting the interests of criminal victims in a weak position and the stability and development of the society.
