摘要
基于中华民族多元一体格局与文化差异,当下我国少数民族犯罪治理工作践行"两少一宽"政策。这一在"严打"期间形成的独特少数民族刑事政策有其特有的时代内涵与历史价值,有必要对其内涵与价值进行历史性考察,并在此基础上进行反思与重构。然而,由于对政策基本内容与适用条件的认识视角的差异,对政策的理论界说聚讼纷然,在政策的理解执行上甚至存在一定偏差,故对诸学说进行梳理比较分析并进行整合与反拨是从理论上对政策进行合理界说的重要前提。同时,还必须从身份到问题,从自身到系统,从政治到法治,对政策进行"与时俱进"的现实扬弃。总之,新时期民族政策的实施首先要明确界定"民族问题",并促成民族事务处理过程中法治思维与法治方式的养成,进而用法律来保障民族的团结。
The policy of ＂Less Wide＂ is used in minority criminal governing in our country which is based on pluralistic integration and cultural diversity of Chinese ethnic peoples.As a peculiar minority criminal policy,it was formed in the period of ＂Strike-hard Operation＂ and it had its own connotation and historical value that deserve serious historical investigation,on the base of it,reflection and reconstruction is needed.However,disputes on the theoretical identification of the policy vary because of different views on basic components and operation conditions,even deviations appears during executing the policy.For this reason,it becomes very necessary to compare,to analyze,to integrate and to reflect theories of different schools and that will be significant precondition for reasonably identifying the policy.Meanwhile,it is needed to fulfill actually sublate about the policy in order to catch up with the time pace from the identity to problem,from itself to the system,from politics to law ruling.All in all,clearly defining the ＂national problems＂ should be the first step of fulfilling the policy in new time,and facilitating the forming of legal thinking and legal ways in handling nationalities affairs,and then to safeguard the national unity by the law.
