摘要
默示许可制度适用于图书馆使用数字版权的价值受到学术界的关注。本文通过对图书馆版权管理实践的举例,介绍了默示许可的主要法律特征,阐述了建立与实施图书馆数字版权默示许可制度的意义,就制度设计涉及的操作规则、适用范围、权利人享有的解除权、报酬请求权和异议权,以及图书馆等版权使用者享有的默示许可抗辩权等问题作了分析。
The implied license system is suitable for the use of digital copyright in the library. Through the practice of library copyright management, this paper introduces the main legal characteristics of implied license, expounds the significance of establishing and implementing the implied license system of library digital copyrights, and analyzes the operating rules, the application scope, the right of claim, the right of compensation claim, the right of claim and the right of implied license.
