摘要
涉水专利技术具有处理对象与法律拟制的双重稀缺性,已成为美国、日本、欧洲、韩国等国家和地区激烈竞争的重点技术领域。分析国际专利分类表中的涉水专利技术可以看出:现代专利法的实用性标准保障了涉水专利技术的积极社会效果和产业应用,新颖性标准确保了涉水专利技术是全新的,而创造性标准则保证了涉水专利技术的进步性。实证数据和个案实例则表明:涉水专利技术在农业、工业和饮用水领域的应用都呈稳步增长的趋势,环境保护立法的完善和专利保护的加强则进一步推动了这种产业化应用。比较而言,我国现状的涉水专利技术自发申请量较大,但整体布局和产业应用的制度引导有所欠缺,因此应当加强引导涉水专利技术研发和投资的立法,修订水资源和水环境相关立法,健全绿色专利审查通道,提升专利审查质量,加强专利保护。
Water-related patents have double scarcity of processing object and legal fiction, which becomes a key technical area of fiercecompetition among America, Japan, Europe and Korea, etc. Specific analysis of water-related patents in the international patent classificationdemonstrated that the utility standard of modern patent law guarantees the positive social effect and industrial application possibility of water-related patents, the novelty standard ensures water-related patents are totally new, and the creativity standard ensures the technical advanceof water-related patents. The empirical data and case examples indicate that the application of water-related patents have a trend of steadygrowth in the field of agriculture, industry and drinking water, and the improvement of the environment protection legislation and thestrengthening of patent protection is further promoting such industrialization application. Comparatively speaking, the current situation ofChina's water-related patents is that there has a large spontaneous patent filing number with the defect of lacking systematic guide in overalllayout and industrial application. Therefore, it should strengthen the legislation guiding the research and investment of water-related patents,revise relevant laws of water resources and water environment, improve the green patent examination procedure, perfect the patentexamination quality, and strengthen the patent protection.
