摘要
指定监视居住检察监督是确保指定居所监视居住强制措施正确运用的重要保障,是规避指定居所监视居住执行风险的最有效方式。指定监视居住检察监督具有充分的法理基础,应当从与国际社会法律文件接轨、赋予检察机关对指定监视居住决定审批权和指定监视居住决定的司法救济制度等三个方面来不断完善我国的指定监视居住检察监督机制。
The procuratorial supervision on the surveillance of specified residence is an important guarantee for the correct application of relevant coercive measures and also the most effective way to avoid risks in implementing the surveillance on specified residence, which has sufficient legal basis. The author thinks that the procuratorial supervision on the surveillance of specified residence should be constantly optimized from three aspects including integrating it with international legal papers, allowing procuratorial institution to have the right of approval for surveillance on specified residence and improving the relevant judicial remedy system.
