摘要
鉴于重大环境决策社会风险评估与环境影响评价之间的内在联系,在构建重大环境决策社会风险评估制度时,应注意其与现有环境影响评价制度的衔接。为此,应依据融合路径构建我国重大环境决策社会风险评估制度,并以我国现有环境影响评价制度为基础对重大环境决策社会风险评估的主体、范围和内容进行界定。此外,还应从调整对象的扩充、专门法规的制定、外部监督和责任追究机制的强化三个方面完善我国现有的环境影响评价法规体系,以便为重大环境决策社会风险评估制度提供充分的法律依据。
For the inner relationship between the social risk assessment and environmental impact assessment of important environmental decisions,its connection with the environmental impact assessment system should be emphasized in constructing the social risk assessment system for important environmental decisions. For this aim,we should construct the social risk assessment system in a combining approach,and define the subject,scope and content of the social risk assessment of important environmental decisions according to our current EIA system. Besides,in order to provide full legislative support for the system,we should also improve the EIA laws by expanding its regulating object,enacting professional regulations,and strengthening the supervision and prosecution mechanism.
