摘要
政府法律顾问制度在西方法治国家的发展已经比较成熟,而我国还处于探索阶段,相关的制度建设并不完善,有一些问题还有待讨论。在认识上,要明确政府法律顾问的身份定位、捋清与政府法制部门的关系;在制度设计上,要明确政府法律顾问的法律地位、职责、权利义务,建立各级法律顾问制度,促进法律顾问组成的多元化、体系化、制度化。此外,还要建立政府法律顾问的配套机制,如遴选机制、考核机制、责任机制、保障体制。
The government counsel system in the western rule of law has become more mature,while China is still in the exploratory stage,the associated system construction is not perfect,and there are still some issues to be discussed. On the understanding,it is to clear the identity in the government’s counsel,and to clarify the relationship with the government legal departments. On system design,it is to clarify the legal status,responsibilities,rights and obligations of the government counsel,to establish legal system at all levels,and promote the diverse,systematic and institutionalized structure of counsels. Also,it needs to establish the government counsel supporting mechanism,such as the selection mechanism,the evaluation mechanism,the responsibility mechanism,and the safeguard system.
