摘要
商标功能理论是商标的核心基础理论。商标功能的确立及其演进,其背后无不蕴含深刻的经济、社会和文化因素。在不同的历史时期和经济增长阶段,以及在同时期的主流消费观念的影响下,商标不断演绎出新的功能以顺应并且助推社会经济的发展。从社会经济发展的特征和消费观念的视角来建构商标功能理论,探索和揭示社会经济运行与商标功能发挥两者之间的内在关联和基本规律,能够更好地了解商标的本质属性及其运行机理,进而能够更好地为商标法律实践服务。
The theory of tradernark's function is the central theory in trademark law. There are profound economic, social and cultural background behind the establishment and evolution of trademark's function. In the different historical periods and economic growth stages, and under the influence of mainstream consumption concept, the new function of trademark has been constantly produced to follow and promote the development of social economy. In order to have a better understanding of the essential attributes and operational mechanism of trademark, and further to benefit the legal practice, it is necessary to construct the theory of trademark's function from the perspective of social economic development's characteristic and concept of consumption, and explore the relationship and basic rules between the economic operation and trademark's function.
