摘要
创新驱动发展中的最优专利制度旨在从国家制度运行、市场规律运行和政策有效性三个方面寻找最优的制度路径。其既讨论专利制度发展中的法律与政策实践,更从经济学角度解释制度运行的市场规律和最优绩效;进而为寻求建立以专利为核心要素的创新驱动战略,实现由独立专利政策向协同创新政策转变,酝酿与创新驱动相适应的知识产权体制机制,提出可能的改革举措。
The optimal patent system is aimed to find the optimal path for innovation-driven development from three aspects, which are the operation of the state patent system, the operation of the market principle and the effectiveness of patent policy. The optimal patent system not only discusses the legal and policy practice, but explains the optimal market rule and performance from the perspective of economics. And then, to seek how to establish patent as core elements in the innovation driven strategy, how to prompt the transformation from independent patent policy to cooperative innovation policy, and how to propose the possible reform initiatives of the national Intellectual Property system which is suitable to innovation driven strategy in China.
